terms and conditions for sale of goods
1 Agreement
These terms and conditions govern the sale and supply of goods by
Y Ffynhonnell Ltd (Company Number 04486909) to you. Each order will
constitute a separate supply agreement between us. No other terms
or conditions will apply unless agreed between us in writing.
2 Specification of goods
All sizes are approximate "to fit" sizes and are given
as a general guidance only. Colours, shades, materials and sizes
of goods may vary to a minor extent from any illustrated. All goods
are subject to availability. We may cancel a supply agreement, or
offer suitable alternative items, if the goods ordered are out of
stock or no longer available.
3 Prices and payment
The prices and availability of the goods are specified on the CMC
web site (http://www.clwbmalucachu.co.uk), and are subject to change
without notice. All prices are inclusive of VAT where applicable.
There shall be an additional charge for packaging and posting.
4 Delivery
Delivery of the goods will be deemed to have taken place immediately
upon us posting them to an address which you supply. You must accept
delivery of all goods which are in good condition and which are
as ordered. Y Ffynhonnell Ltd will endeavour to despatch all goods
within 28 days of receipt of order. If there is any reason why goods
are delayed, you will be contacted by email and will be allowed
the opportunity to cancel your order.
5 Quality
We undertake that the goods will, in all material respects, comply
with any general description which we may have submitted to you,
will be of satisfactory quality and reasonably fit for the purpose
for which they were manufactured subject to normal usage. Unless
specifically stated otherwise, all garments are for leisure, and
not sports, use.
6 Returns policy
Y Ffynhonnell Ltd take great care to ensure that all the items we
sell are of the highest quality. Should you be unhappy in any way
with any of our products, we operate a FULL MONEY BACK POLICY. You
can return any goods to Y Ffynhonnell Ltd for an exchange or refund,
providing each is returned in perfect condition, unworn and unwashed,
within 10 days of receipt of goods. You shall be responsible for
the cost of returning goods for refund or exchange. Y Ffynhonnell
Ltd recommends that you use registered post or recorded delivery
when returning goods. Y Ffynhonnell Ltd shall use reasonable efforts
to replace damaged or defective goods but if replacement is not
possible, or if an order is cancelled for any other reason under
these Terms, Y Ffynhonnell Ltds only obligation is to refund
the full amount paid by you. This does not affect your statutory
rights.

7 Your right to cancel
Under the Distance Selling Regulations, you have the right to cancel
the contract for the purchase of any item within seven working days
of delivery. We cannot accept cancellations or returns for any goods
which have been worn or used. If you wish to cancel you should wrap
the item for which you are cancelling the contract securely, and
send the item back to reach us within seven working days of the
date that the item was delivered to you. Please note that you will
be responsible for the cost of returning the goods to us.

8 Intellectual property rights
All copyrights, trademarks, patents and other industrial or intellectual
property rights which may arise as a result of, or be displayed
or incorporated in, any written, printed or electronic material
or any brochure which we may produce is either our property or that
of third parties and is not to be reproduced used or exploited in
any manner whatsoever. You will indemnify us from and against all
costs claims and liabilities which we may suffer or incur as a result
of you using, reproducing or exploiting any such industrial or intellectual
property rights without the consent of the proprietor.
9 Governing law and jurisdiction
A supply agreement shall be governed by the Laws of England and
shall be subject to the exclusive jurisdiction of English Courts
of Law.
10 Invalidity of terms and conditions
We both agree that these terms and conditions strike a reasonable
balance between our respective interests. If any of these terms
and conditions shall be invalid or unenforceable for any reason
then that shall not affect the validity of the remainder of these
terms and conditions which will remain in full force and effect
but as if any such invalid or unenforceable term or condition had
never formed part of it.
